Bylaws of the Board of Directors Our Homeowners Association Board has a specific set of rules, known as Bylaws, that govern how they make decisions, and how their decisions are applied. The Bylaws are separate from our Covenenants and only pertain to the Board of the Association. Covenants of the Association When we each purchased our home, we agreed to the terms and conditions outlined in the "Declaration of Covenants" given to each buyer, by your MDC Sales Representative, when you signed your contract to buy your home. Another copy may have even been provided during your closing. We ask that you familiarize yourself with these rules and follow them. If you do not have a copy of our current Covenants, you may print them from here. Declaration of Covenants, Conditions and Restrictions for Ashebrook Architectural Review Article VI of the Covenants states that if you want to make any physical changes to your property, they must first be approved by the Architectural Review Committee. This includes, but is not limited to fences, sheds, patios, walls, sidewalks, additions to driveways, any exterior color changes, or additions or major landscaping. We have included a .pdf version of the Architectural Review Form here on the website for your convenience: Once you have opened this form, you may fill it out online by clicking on the appropriate lines. However, please remember that it must be printed out and sent CERTIFIED MAIL to the Architectural Review Committee at the address listed on the form. You may email Architectural Review Committee with any other questions or concerns not requiring official action. If you want to place a shed on your property, remember to contact the Architectural Review Committee. Also, according to the Building Division of Cabarrus County, any sheds that you place on your property must be a minimum of five (5) feet from the property of others, or with the building setback if it will be along the side of your property that borders a street or sidewalk. You will need a zoning permit that cost $50 in order to legally build your shed. If you intend to run electricity to the shed, you must also obtain a building permit. Complaint Procedures If you really want to see something done about the circumstances that are offensive to you, send your complaint to the appropriate Board or Committee member. If you are not sure who you should contact, check your bylaws. Anything that is visually offensive or prohibited changes to the front of one's home, ie., a brick wall where the garage door is supposed to be or a bird bath in the front yard, contact the Architectural Review Committee through the above link. Mostly anything else can be directed to any board member. One of the most common complaints we have heard is about "pet problems". Stray cats, dogs barking in the middle of the night, or dogs that are too close to the street and scaring people who walk past on the community sidewalk. In paragraph 6.8 of our Covenants, it is stated that "All household pets shall be kept under Owner's control so as not to be a nuisance to other Owners." As a board there isn't actually much that we can do, other than to send a letter to the Owner whose pet is causing problems. However, Cabarrus County does have Animal Control laws that we must all abide by, or that may apply to your particular situation. Keep in mind that the Animal Shelter for Cabarrus County will not come get stray cats, you must bring them in yourself. .
